Hi Dan,
I agree with your assessment about changing facilitators of the virtual 
state committee meeting. I think the move to change the agenda of the 
virtual state committee meeting also falls into this category, especially 
as the proposal to limit the agenda (#2 from the virtual meeting) was 
already rejected by the virtual meeting.

I've been reading the relevant section of our bylaws about appointing 
proportional representation seats to StateCom (8.5.2). I think the key 
piece is the last paragraph of this section and, in particular, the last 
sentence, which is clear that PR seats appointed by the State Committee 
have identical rights and responsibilities of those elected at regional 
conventions. 
"A regional PR member appointed in this manner by the State Committee 
shall have identical responsibilities and rights as a member elected at a 
regional convention."
Since those elected at regional conventions are described as serving from 
"the day following their election" I don't think we can delay when these 
appointments start by more than a day, although I understand that we've 
traditionally appointed people to begin serving at the meeting itself. 
For those elected at regular regional conventions: "The terms of members 
so elected will begin the day following their election and end two years 
later."
For those appointed later:  "The term of an appointed regional PR State 
Committee member will end at the same time as the elected regional PR 
State Committee delegates, or at the next regional convention of that 
region, whichever comes first. "

I see in the bylaws that we're supposed to give 3 months notice for state 
conventions (article 6.8). Can you point me towards the conflicting rules 
that say the meeting must be held by the end of August, please?

This action is not valid on three accounts:

1. A proposal was not presented, not even a place holder, two weeks 
before the meeting.

2. The action to change facilitators of the in process virtual state 
com meeting is not an urgent issue, nor was it was agreed to as an 
urgent item at the beginning of the meeting when the urgent items 
were agreed to.

3. Each statecom meeting has its own process. If people want to 
change the facilitators in the virtual meeting, that needs to be 
brought up in the virtual statecom meeting. Having one statecom 
meeting try to apply power over another statecom meeting does not 
make sense. Each holds equal statecom power in itself.

Wanda was approved by the virtual special statecom meeting already. 
It appears that Jamie, Eli and Wanda will work this out with Jamie 
and Wanda staying as facilitators.

There is no explicit provision to allow election/appointment of reps 
to statecom at a delayed date. Eli suggests that the bylaws could be 
interpreted that way. We need to look into this.





X. State Convention Date in November: Not valid accordance to bylaws

Statecom picked a date that is definitely in non-compliance with our 
bylaws. Our bylaws state loosely that the date must be by the last 
date to file nomination papers with the secretary of the 
commonwealth. That was either June something for state party 
nominations or late August for minor or independents. So if we use 
the second date, then late august is still doable technically. But as 
far as notifying people, there are a lot of problems.

We either need to pick a new date by statecom to be before late 
August to be in compliance with loose language in bylaws, or if any 
date after late august will need to have a one time bylaw exception 
for 2008 or a general allowance in the bylaw for changing date after 
what is already in the bylaws.

Merelice and Dan are supposed to come up with something for next 
adcom, July 19th.
